Netvibes is an online service allowing the user to create a free, customizable web 2.0 homepage. It gives the user the ability to put together data feeds and services from web 2.0 applications with a very simple interface. The service provide advanced functionalities that enables you to import your own RSS feeds and to read them with an integrated RSS/ATOM feedreader. You can easily import an OPML file as well. With Netvibes you can also download and listen to podcasts without any additional software, check your e-mail on one or many Gmail accounts, stick web notes and weather updates. The service will be further extended with new functionalities.

[modifier] NETVIBES GENERAL TERMS OF USE

1. INTRODUCTION This agreement ("Agreement") between You and NETVIBES consists of these NETVIBES Standard Terms and Conditions ("Terms and Conditions"). A description of the NETVIBES ONLINE SERVICES, as generally offered by NETVIBES, is available at http://www.netvibes.com/loc/en_about.html. "You" means any entity identified in an enrollment form submitted by the same or affiliated persons, and/or any agency or network acting on its (or their) behalf, which shall also be bound by the terms of this Agreement.

2. OFFER AND ACCEPTANCE Participation in the NETVIBES ONLINE SERVICES is subject to NETVIBES prior approval and Your continued compliance with the current policy located at http://www.netvibes.com/loc/en_privacy.html. NETVIBES reserves the right to refuse participation to any applicant or participant at any time in its sole discretion. By enrolling in the Program, You represent that You own the right to do so and you agree that NETVIBES may serve third party and/or NETVIBES provided advertisements.

3. LIABILITY AND LIABILITY LIMITATIONS You are solely responsible for your use of the NETVIBES ONLINE SERVICES, as well as for the content and materials You will use with.

NETVIBES makes no guarantee regarding the use of your work, the timing of delivery or the amount of any payment to be made to You under this Agreement.

NETVIBES MAKES NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WITH RESPECT TO ADVERTISING, LINKS, SEARCH, AND OTHER SERVICES, AND EXPRESSLY DISCLAIMS THE WARRANTIES OR CONDITIONS OF NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE.

EXCEPT FOR ANY INDEMNIFICATION AND CONFIDENTIALITY OBLIGATIONS HEREUNDER OR YOUR BREACH OF ANY INTELLECTUAL PROPERTY RIGHTS AND/OR PROPRIETARY INTERESTS RELATING TO YOUR WORK, (i) IN NO EVENT SHALL EITHER PARTY BE LIABLE UNDER THIS AGREEMENT FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY, OR PUNITIVE DAMAGES WHETHER IN CONTRACT, TORT OR ANY OTHER LEGAL THEORY, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND (ii) NETVIBES'S AGGREGATE LIABILITY TO PUBLISHER UNDER THIS AGREEMENT FOR ANY CLAIM IS LIMITED TO THE NET AMOUNT PAID BY NETVIBES TO PUBLISHER DURING THE THREE MONTH PERIOD IMMEDIATELY PRECEDING THE DATE OF THE CLAIM. Each party acknowledges that the other party has entered into this Agreement relying on the limitations of liability stated herein and that those limitations are an essential basis of the bargain between the parties. Without limiting the foregoing and except for payment obligations, neither party shall have any liability for any failure or delay resulting from any condition beyond the reasonable control of such party, including but not limited to governmental action or acts of terrorism, earthquake or other acts of God, labor conditions, and power failures.

4. TERMINATION Subject to any third party agreements You may have with other NETVIBES customers You may stop providing your work in the Program with or without cause at any time. You may terminate this Agreement with or without cause at any time by sending notice of your desire to cancel Your participation in the Program. This Agreement will be deemed terminated within ten (10) business days of NETVIBES's receipt of Your notice. NETVIBES may at any time, in its sole discretion, terminate all or part of the Program, terminate this Agreement, or suspend or terminate the participation in all or part of the Program for any reason.

5. CONFIDENTALITY NETVIBES agree not to disclose Your Confidential Information without Your prior written consent. "Your Confidential Information" includes without limitation: (a) all specifications, materials, guidelines and documentation relating to your work; (b) rates or other statistics relating to your work; and (c) any other information designated in writing by NETVIBES as "Confidential" or an equivalent designation. However, You may accurately disclose the amount of NETVIBES’s gross payments to You pursuant to the Program. NETVIBES Confidential Information does not include information that has become publicly known through no breach by You or NETVIBES, or information that has been (i) independently developed without access to NETVIBES Confidential Information, as evidenced in writing; (ii) rightfully received by You from a third party; or (iii) required to be disclosed by law or by a governmental authority.

This Wikinews Copyright License is binding upon the Authors contributing to Wikinews and the Users of Wikinews content.

Distribution, performance and use in printed and digital media, with or without modification, are permitted provided that the following conditions are met:

Distributions of the Work or of a modified version thereof must display the above copyright notice, this list of conditions and the following disclaimer, or a universal resource identifier linking to this License and to the list of Authors.
Credits can be given to Wikinews, which maintains the history of the Works including the full list of original Authors and their contributions.
Neither the name of Wikinews nor the names of the Authors may be used to endorse or promote products derived from their Work without their specific prior written permission.

It is provided by the Copyright Holders and Contributors "as is" and has no warranty, express or implied, for any purpose.
